AAJ Statement on H.R. 6730 the “Injunctive Authority Clarification Act of 2018”

Washington, DC — The following is a statement from American Association for Justice CEO Linda Lipsen on H.R. 6730, the "Injunctive Authority Clarification Act of 2018." This bill, voted out of the House Judiciary Committee, calls for a ban on national injunctions. National injunctions, when granted, stop a defendant from causing irreparable harm to all affected people, rather than just the harm to a specific individual. A total ban would strip the courts of their ability to prevent certain immediate harms.

"The ban on national injunctions is an example of extreme overreach that will lead to uneven application of justice…just imagine if the injunction in Brown v. the Board of Education only applied to the plaintiffs themselves. Now more than ever, it’s imperative that courts be able to use these injunctions as a check and balance."
